The initial lawsuit, which was dismissed by Judge Kathleen Williams in mid-July 2026, claimed damages related to the leak of Trump’s tax returns but was found to be a strategic move to justify a $1.776 billion “lawfare” fund created as part of a settlement with the Department of Justice. Following the ruling, Trump has publicly criticized the scrapping of the fund during a Cabinet meeting at Camp David, expressing dissatisfaction with the Senate's hesitation in confirming his nominee for U.S. attorney general, Todd Blanche.

The controversy surrounding the $1.776 billion lawfare fund is a significant stumbling block for Blanche's nomination, with several Republican senators demanding written confirmation that the fund is permanently defunct. Blanche had earlier testified in Senate hearings and did not explicitly rule out that some funds might benefit individuals charged with crimes related to the January 6 Capitol riot, a position complicated by Trump's pardons and vocal sympathy for the riot participants. Trump defended the fund in a Truth Social post, asserting his support for compensating those he views as victims of government overreach.

The legal dispute also involves substantial protections granted to Trump and related parties, including immunity from IRS enforcement actions related to their past federal tax returns. Judge Williams’ July 13 order went beyond dismissing the case to impose sanctions on two of Trump's attorneys, Alejandro Brito and Daniel Epstein, including referral for disciplinary action and temporary court appearance bans. Williams declared the lawsuit was a tool to enforce agreements that had no legitimate legal basis and barred the parties from invoking the settlement as evidence of any valid legal resolution.

The Department of Justice has pushed back against the judge's findings, categorically denying any collusion and characterizing the ruling as partisan and unfounded. Despite these legal battles, the validity of the private settlement agreement itself remains unresolved in court. Trump's legal team reaffirmed their position condemning the IRS leak and vowed to continue holding accountable those they believe wronged the American public, as the appeal process advances in the U.S. Court of Appeals for the 11th Circuit.
